As appeared in the Missouri Republican Newspaper April 27th 1826:
DIED - In this county, on the 7th instant, in the 84th year of his age, Mr WILLIAM WALTON. Mr Walton was one of the remaining few of those who fought the battles of the Revolution. For several years previous to his death, he had been an inhabitant of this county.
Will of Mary Walton (Wife of William Walton)
In the name of God AMen; I Mary Walton of the County of St Louis and the State of Missouri being old and well stricken in years, and knowing that it is appointed once for all men to die, do make and ordain this my last will and testament.
(First) I give my soul to God who gave it; and my body I resign to the grave;
(Secondly) I give to John Walton and Nancy Hawkins over and above the rest of my children (to wit) To John Walton Two Hundred Dollars; and to Nancy Hawkins, Eighty Dollars;
(Thirdly) I give to William Walton son of Weshack Walton, Two cows one with young calf and two year old cattle;
(Fourthly) It is my will and desire that the remaining part of my estate after all my just debts are paid should be equally divided between my children:

Joseph Walton Three Hundred Dollars to be deducted out of Joseph Walton's part for A note I held against him, having give him said note.
(Fifthly) I reserve Ten Dollars of my estate and do and do give it to my son Henry Walton; as I believe he has had his equal share therefore;
In testimony I have hereunto set my hand and fixed my seal this 20th day of June in the year of our lord One Thousand Eight Hundred and Thirty-Eight.

In the name of God, Amen, I William Walton of the County of St Louis and State of Missouri being in perfect mind and memory do make and ordain and constitute this my last will and testament (hereby revolking all others that may have been heretofore, made by me).
First:
Insign my Soul into the hands of Almighty God and my body to the earth, and my worldly estate I dispose on in the manner following.
Secondly:
After the payment of my just debts, my Wife Mary Walton is to have such portion of the reside of my estate as the I one - would have given her had I died intestate, to enjoy the same for and during her natural life.
Thirdly:
I hereby devise and bequeath the residue of my Estate after payment of debts and deducting the dower as aforesaid, unto the following persons in eight equal portions as follows to wit: One eight there of unto Nancy Walton, Widow of my son William, and to her three children, to go to said Nancy and her three children in Equal Parts; and one eight thereof unto each of my children now surviving to wit, John Walton, George Walton, Jacob Walton, Henry Walton, James Walton, Joseph Walton and Nancy Hawkins.
Forthly:
Thereby give and bequeath to William, John T Polly, Rhoda, beign Children of my deceased Son Meshack Walton, the sum of four hundred dollars to be divided equally between them, it being in full of said Son's portion.
Fifthly:
I hereby give and bequeath into Narcepa. Polly M., J Malinda, C Chitesen of my deceased daughter Elizabeth Lukeford the sum of three hundred dollars to be divided equally between them.
Sixthly:
I also give and bequeath until Marcipa, George W Thomas and James, the children of my deceased daughter Rebecca Chapman the sum of ten dollars to be divided equally among them (my said deceased children mentioned in the forth-fifth and sixth articles above having received in their lifetime either the whole or a portion of their equal part of my estate).
Seventhly:
On the decease of my said wife Mary, I hereby devise said third article.
Eightly:
It is my will that my Executros herein after named in settle with the legatees mentioned in the third article above, shall charge against any of said legatees and devises as a part of their portion already received, any account that I may have in writing against such persons, whether it be for money loaned or property given or for any other thing; or in the case of the widow of the children of my deceased Son mentioned in said third article, any account which I may have in writing against my son William.
Ninthly:
Also it is my will that any account which I may have in writing against any of my deceased children's children mentioned in the fourth, fifth, and sixth articles above shall be deducted from the portion that such Grandchild would otherwise have received under the will as his part; and shall also be deducted from the amount herein before enjoined in the same articles to be paid over to the children of the father or mother of such grandchildren.
Lastly:
I hereby appoint my sons Jacob Walton, Henry Walton and James Walton, executors of this my last Will and Testament; making them trustees to the purposes of "this". Hereby devising and bequeathing to them all my estate, for the uses here in mentioned and vesting in them the title to all my lands and personal property. And give conveyances therefore the proceeds thereof to be held to the uses of this will as declared above. And I hereby give full authority and power to my said Executors, as far as regards the above mentioned devisees and legatees to act in a discontionary manner and exonerate them from all recourse that such legatees and devisees might otherwise have had against them.

Judge of the Probate Court within and for the County of aforesaid personally appeared Thomas Clark one of the subscribing Witness to the forgoing instrument of writing duly proven to be the same person by Joseph Walton and William Hawkins and the said Thomas Clark being by one duly sworn upon his oath declareth and saith that the above and written named William Walton signed and published the or this instrument in writing as his last will and testament and that at the time he signed and sealed the said instrument he the said testor was of sound and disposing mind and that he this said deponent and the above named Alexander Clark and John Brown subscribed their names thereto in presence of the said testor and in the presence of each other as witness to the same at the request of the said testor - Thomas Clark - sworn and subscribed before one the day and year above written.
