* BIRTH: of Tobias Kelly is estimated from 1840 Talladega Co Alabama, 1860 and 1870 Atascosa Co Texas censuses.
* MARRIAGES: Both marriages for Tobias Kelly are accounted for in "St Clair County Marriages 1818-1889" Publ: Gregath Company, P.O. Box 1045 Cullman, Alabama 35056-1045 and in Alabama Marriages found in Alabama State Archives.
* DEATH: Death records or burials have not been found for Tobias Kelly or either of his wives. The last account we have for him is the 1870 Atascosa Co Texas census and he does not appear on the 1880 census in any Texas county. He would have been 75 years old in 1880.
* CENSUSES: 1840 Talladega Co Alabama, 1860 Atascosa Co Texas, 1870 Atascosa Co Texas.
* LAND: Tobias Kelly swore an Oath to the Republic of Texas in 1837 and was awarded 1/3 league of land (1,476 acres) in Coryell Co Texas. The Oath and resulting records are on file at the Stephen F. Austin University, Ralph Steen Library, Nacogdoches, Texas and at the Texas General Land Office, Archives Division, Austin Texas. Tobias returned to Alabama and brought his family to Texas shortly thereafter. He bought and sold land in Talladega Co Alabama, Montgomery Co Texas and Atascosa Co Texas.

* Husband: This was a second marriage for Tobias Kelly. His first marriage was to Margaret RAGSDALE in St Clair Co Alabama in 1827. She brought at least one child to the marriage named Barnet A. Ragsdale then she bore Tobias a child in 1828 named JOHN GREENBERRY (GREEN B.) KELLY. John Greenberry Kelly is the author's direct line ancestor. Margaret Ragsdale and Tobias Kelly had no other children together. Tobias Kelly is proven as the father of John Greenberry Kelly thru a deed found in Talladega Co Alabama showing Tobias leaving land to his children: Greenberry, Margaret and Marshall in 1838. Margaret and Marshall were children of second wife, Margaret DAVIS. It is believed that MARGARET RAGSDALE KELLY died bet 1828 and 1831 in St Clair Co Alabama.
* Tobias Kelly was awarded custody of James Monroe RAGSDALE and Tobias Kelly RAGSDALE in a guardianship suit against Evan COMER of Atascosa Co Texas in 1858. The boy's mother was MATILDA RAGSDALE COMER. She died in 1858 in Atascosa Co Texas and after the guardianship, the two boys lived with Tobias Kelly and Margaret Davis until they were grown.
* CHILD: John Greenberry Kelly was killed in Atascosa Co Texas in Jun 1858. Michael Kelsey's "Miscellaneous Texas Newspaper Extracts" from The Texas State Gazette, an early Texas newspaper.
* CHILD: Margaret Ann KELLY was married three times to ( - ) DANIELS in St Clair Co Alabama, to John STIDHAM in Atascosa Co Texas and to Eli BIBB in Atascosa Co Texas. Marriage records for the Atascosa Co Texas marriages from the Atascosa County Clerk, Jourdanton, Texas.
* CHILD: Marshall Crockett KELLY married Mary Josephine SLAUGHTER. Hays County Clerk, San Marcos, Texas. Mary Josephine's family were prominent cattle ranchers in South Texas and the family is mentioned in "Trail Drivers of Texas" by J. Marvin Hunter.
