Onondaga, MI, pg 103: 2 males under 5, one male 20-30, 1 fem 5-10, one 20-30 1844 John was a resident taxpayer in Ingham Co.; Onondaga is 17 miles from Spring Arbor, where Concurrence’ parents lived; it is closer to Rives Junction 1850 wife in Lucas Co. OH 28 June 1850; pg. 304-310 Barnhart Long complainant, Fitch Philo and others defendants On 8 Dec 1849 Long (of Wayne Co.) filed a bill from 21 Jan 1846 when he contracted to sell to John J. Darling land in Waynesfield Twp, Town of Monclovia, house and lot # 37. Darling paid $75 down and agreed to pay $25 with interest on 29 Jan 1847 and 29 Jan 1848 and 29 Jan 1849 (total of $150) and was to have possession on 1 Apr 1846, at which time he moved his family in. On 24 Feb 1847 Darling assigned all his interest to Fitch Philo. A deed was made out to Philo. On 1 Jan 1848 said Darling departed this life and left a widow named Concurrence Darling and Gilbert Darling and Oliver Darling and Wm. Darling and Cynthia Darling. Fitch Philo refuses to make his payment. He is also to pay taxes for 1847, 1848, 1849 amounting to 65¢. Long requests that Philo and Concurrence and children be subpoenaed so that payment can be made or property sold. In Dec 1849 The Sherrif was commanded to summon Concurrence and children to appear in court to answer a petition. Fitch Philo was also summoned. Attorney S.E. (J.E.?) Lee(?) was appointed guardian of the 4 children, “infants”. It was agreed that Fitch Philo must pay the balance or the land would be sold.
