33. 1885, 25 Sep: "Carroll Free Press": DEAD Mr. Adkin Upshaw died at his home near here, on last Tuesday, in the 85th year of his age. The deceased was well and favorably known throughout this county where he has lived since 1865. "Uncle Adkin", as he was familarily called, was born in Virginia but moved to Georgia when he was about 8 years of age. When about 35 years of age, he moved to Coweta (County) where his family was raised. In 1863 he moved to Heard County and in 1865 to this County to the place where he died. The deceased was one of the leading members of the Primitive Baptist Church, in the faith of which he died. To the many relatives and friends in the County we extend our condolence.

36. 1885, 16 Oct: "Carroll County Times": Obituary. Died, at his residence near Carrollton Sept. 22nd 1885, Adkin Upshaw, aged 84 yrs., 5 months, and 3 days. He was born in Virginia, April 19th 1801. Moved to Georgia in 1809. Joined the Primitive Baptist Church at the age, 25. Lived a consistent member till death. In the days of his strength, he had heard the preaching of Mosely, Henderson and others who had so successfully filled the pulpits of Georgia and so forcibly taught the doctrines of his Church. Brought up under their teaching, it is not a matter of wonder, that he should have remained so firmly fixed in his faith. When Brother Upshaw joined the Church by the preaching of the Gospel wise men were made wiser, and bad men were made better. It was a time when the world was forced to acknowledge the divine power of the Gospel. In the latter part of his life he, especially, devoted himself to the reading and study of the Bible. It was his comfort in this life and hope for the world to come. Quiescat in Pace. A Friend.

State of Georgia/ In the name of God, amen. I, Adkin Upshaw of said State and Carroll County /County, being of advanced age and knowing that it is appointed once for men to die, do make this my last Will and Testament, hereby revoking all others heretofore made by me.
1st Item: I desire that my body be buried in a plain and decent manner, my Soul, I trust will return to God who gave it, as I hope, for eternal Salvation, through the merits and atonement of the blessed Lord and Saviour Jesus Christ.
2nd Item: I desire and direct that all my just debts be paid without delay by my executors, herein after appointed.
3rd Item: I give and bequeath to my beloved wife, Mary C. Upshaw, all of the tract of land whereon I now live, containing one hundred and fifty acres, more or less, with all the rights, members, and appertenances to said tract of land in anywise belonging to her own proper use, benefit and behoof forever with full power to dispose of the same at any time previous or by will or deed at her death as she may think proper. I do also give and bequeath to my beloved wife, in the same unreserved manner, all my farming utensils, horses, mules, cattle, hogs, sheep, buggies, wagons and household and kitchen furniture belonging to and used on said plantation.
4th Item: I give and bequeath to my daughter Beady Jane Smith five dollars in money at par.
5th Item: I give and bequeath to my daughter Holland K. Urquhart ten dollars in money at par.
6th Item: I give and bequeath to my daughter Curacy Ann Marchal ten dollars in money at par.
7th Item: I give and bequeath to my daughter Susan F. Darden five dollars in money at par.
8th Item: I will and desire that the remainder of my estate be equally divided between my beloved wife Mary C. Upshaw and my three sons, John R. Upshaw, Joseph T. Upshaw, and Robinson V. Upshaw.

13. 1898, 10 Jun: The Cherokee (Co., Ga.) Advance, page 3, col. 3: Mrs. Ben F. Perry received the sad intelligence of the death of her father, John R. Upshaw, at his home near Talladega Spring, Ala., on Monday last. Mr. Upshaw was about 69 years of age and had been in feeble health for some time, but he had looked forward to the re-union of the Confederate soldiers in Atlanta next July with anticipations of delight in again meeting many of his old comrades and in visiting his many friends and relatives in Georgia at that time, but he was called to the re-union beyond the grave before that pleasure had been given him. He was a member of the Primitive Baptist church and one of the best men of his church and state. He leaves a wife and three children, Mrs. Shelby W. Nelson of Columbiana, Ala., Atkins W. Upshaw of Talladega, Ala., and Mrs. Ben F. Perry of Canton, Ga. He was an uncle of "Earnest Willie" Upshaw and had many other relatives in this state.

Her husband, W.H. Marshall, is buried at Old Chatfield Cemetery, Navarro Co, Texas, and there is no marker for Curicy there. Is there an unmarked grave next to his there? Mrs. Jennie Smith, aged 80, died at her home on Dixie Street at an early hour last Friday morning, Feb. 7th. Mrs. Smith had been in declining health for a number of months and her death was not unexpected by relatives and friends. The funeral was held from the residence Saturday morning at 10 o'clock by her pastor, Rev. Jesse M. Dodd. Interment was held in the City Cemetery immediately following. For more than fifty years she had lived in Carrollton. Before marriage, she was Miss Jennie Upshaw and was reared in Carroll County. She was Postmistress for nine years, serving from 1900 to 1909, when she was succeeded by her son, Mr. C.E. Smith. She was the widow of the late George M. Smith who passed away 20 years ago. Two children survive her, Mr. Claude E. Smith and Miss(sic) Mattie Cobb, both of this city. The Free Press joins the many friends of the deceased in extending sympathy to the bereaved family. 13. 1919, 13 Feb: Carroll County Times; obituary of Jennie (Upshaw) Smith: Mrs. Jennie B.Smith Called by Death. 11. 1872, 8 Nov: Carroll County Times (newspaper), issue of Friday, 8 Nov 1872: Apples in Carroll - Mr. R.V. Upshur(sic) informs us, that he has pulled twenty one bushels of apples off of one tree this season. Estimating the bushel as containing 270 apples, this would make 5670 apples from a single tree. They were of the celebrated golden variety, which has acquired so much celebrity in this section.
12. 1872, 29 Nov: Carroll County Times (newspaper), issue of Friday, 29 Nov 1872: Runaway -On last Tuesday evening, Bob Upshur(sic) and Jno. Worthy were driving out of town on the Villa Rica Road, the former in a top buggy, and the latter in a one horse wagon behind, the horse of the latter became frightened, and ran the wagon against the buggy of Mr. Upshur(sic), who was just in front, breaking the spindle off of one of the hind wheels. The horse of Mr. Worthy stopped immediately after the collision and Bob's fine gray paid no attention to the racket.

Item 1: Inquiry from the State of Oklahoma, pension department, Oklahoma City, to the Adjutant General, War Department, Washington, D.C. dated 21 August 1925, requesting a record of R. V. (or "Bod") Upshaw, Co. G. (sic) 1st Georgia Cavalry Regiment (Wheeler's Cavalry).
Item 2: Reply to the above dated 26 August 1925, giving the following record: R.V. Upshaw (also born as Roberson(sic) Upshaw, but not as "Bod" Upshaw), enlisted March 4, 1862 at Newnan, Georgia, in Company "B", 1st Georgia Cavalry, C.S.A.; not found as of Company "G", muster roll November & December 1864 (the latest on file) shows him present, a Private. Prisoner of War records show that he was paroled at Charlotte, North Carolina, May 3, 1865, in accordance with terms of a Military Convention held on April 26, 1865, a Private.
Item 3: A letter, dated 5 November 1925, from the Oklahoma Confederate pension Department to "Hon. T.B. Hogg, Shawnee, Oklahoma", who evidently assisted Ida S. Upshaw in obtaining the pension application forms. Mrs. Upshaw submitted an application which was not properly prepared or witnessed, and the Pension Department states that it will have to be returned and correctly completed.
Item 4: "Application of Indigent widow of Confederate Soldier or Sailor, for a pension under the laws of the State of Oklahoma", dated 7 November 1925. Ida S. Upshaw, 323 S. Park, Shawnee, Oklahoma, a resident of Pottawatomie County, Oklahoma; I have lived in the state of Oklahoma continuously for 25 years; born in Alabama, 64 years old (born 1861). Do not own a home nor property of any kind; in poor physical condition; not able to work. Occupation: sell face powders to ladies. I am applying for a pension because I am indigent and unable to earn a livelihood by manual labor. My husband's full name is Robert Valentine Upshaw. I have not remarried since his death; I was married to him at Jackson's Gap, Alabama (no date given); he died at Shawnee, Oklahoma (no date given); he never drew a pension. He enlisted in Georgia and served in the First Georgia Cavalry, Company "B", and was paroled in May 1865; he was not a commissioned officer. (signed) Ida S. Upshaw.

RESEARCH Notes:
1. The Georgia Archives shows no Tax Lists for Carroll County from 1873 to 1899, although 1890 & 1891 (and perhaps others) are at the Carroll County Library (see note above); perhaps the Archives' inventory is incorrect? (Need to check).
COMMENTS:
1. The birthplace of Robinson Upshaw was Coweta County, Georgia, as his father bought land there in 1838 (Deed Book G, page 189) and on January 13, 1845 (Deed Book G, page 437).
2. Robinson V. Upshaw served in Co. "B", 1st Georgia Cavalry, with his brother John R. Upshaw.
3. Family recollection told to Ted Brooke, by Haskell Upshaw, ca 1975: Robinson joined the Confederate cavalry on 10 May 1862 when he was only 16 years old. His father was very distressed at this, as "his other sons had all gone to the Confederacy and he (R.V.) was her youngest and he didn't want him in danger". His father was able to get him returned, which is evidenced in his service record, in the muster roll dated 13 Feb 1864, which states "Last paid by Capt. May, aqm, to June 30, 1863. Dropped from roll by order of Major J.H. Strickland, Com. Regt". He reenlisted on 20 Nov 1864, either in Newnan or Luthersville, as evidenced on muster roll for Nov & Dec 1864. At some point, either before his first enlistment in 1862 or the second in 1864, the Coweta County Sheriff got involved and is supposed to have confined him in the County jail to keep him at home, which was ultimately to no avail. According to family tradition, he was a large man, about 6'6" in height, and very strong. It is told he could pull apart a piece of harness with his bare hands and would often do this in public as a feat of strength. My father, Theodore Routon Brooke, has told me that he recalls seeing another picture of him, with a long-stemmed pipe, which I have never been able to locate. Sadly, no picture of him in Confederate uniform is thought to exist. Also according to family tradition, he is supposed to have killed or injured a colored man in a fight in Carrollton. Ida, Robinson's wife, was at a well in town and was insulted somehow by the colored man, who was severely injured or killed by Robinson, who then fled to Alabama, where he remarried to Ida Phillips after the death of his wife, and thence moved to Shawnee, Oklahoma, where he died in 1901. My grandmother, Martha C.P. (Upshaw) Brooke, daughter of Robinson, told my father that her father (Robinson) had written her from Alabama while he was "in exile" there, asking her to come and keep house for him, which she did not do; she was married to my grandfather, James Robert Brook(e) on 31 Dec 1891, shortly before her father's remarriage to Ida Phillips in Alabama. An account of this affray in Carrollton should be in the Carroll County newspapers, which are being abstracted and published by the Carroll County Genealogical Society in their "Quarterly", but has not appeared within the issues of 1872-1885, which they have printed thusfar, as of 2009. I think the affray probably happened about 1888-1891 and will make interesting reading, once located. (Notes: No Superior Court case of this supposed incident is found in the Carroll County Superior Court Minute Books from 1879 to1903, although several of the indexes are faulty).
