  * ALand and property records, combined with tax digests, are the key to successful research in Georgia. From 1733 until 1752, while the colony was controlled by its trustees, all land was granted to settlers "in tale male," meaning that the property could not be sold, mortgaged, or willed to anyone other than a male heir. If the grantee had no male heir, the land he owned reverted to the trustees. Once the colony's charter was returned to the Crown, a provincial government was established, and by 1756 settlers were being granted land without restrictions. Kings George n and George ill continued to make land grants until the Revolutionary War. See Pat Bryant, Entry of Claims for Georgia Landholders, 1733-1755 (Atlanta: State Printing Office, 1975). The R. J. Taylor Jr., Foundation has compiled a series of colonial Georgia records. Four volumes have been published to date by Reprint Company, including abstracts of Georgia colonial conveyance records from 1750-1804. One volume is an index to probate records dating from 1733-78.
  * AThe first effective legislation concerning land grants after Georgia became a state, dated 17 February 1783, provided for headrights and bounty land grants. The law allowed each head of household 200 acres free as his own head-right and fifty additional acres for each member of his family and each slave at a cost of from one to four shillings per acre. Grants were limited to 1,000 acres and the grantee was responsible for paying survey and grant fees. Those who had received grants under colonial jurisdiction were entitled to the lands they occupied when the law went into effect.
  * AThe 1783 act also provided for establishing a land court in each county. A land grant applicant would appear before five justices to swear under oath concerning the size of his family and the number of slaves he owned and obtain a warrant of survey. Once the county surveyor completed his layout of the applicant's land, a copy of the plat of survey was forwarded to the surveyor general and the original was filed in the county. The applicant was then required to live on the land for a year and cultivate 3 percent of the total acreage. After meeting those requirements, the applicant could apply to the governor's office for his grant and pay all fees. At that point the grant would be issued and recorded. Headright grants were made in Bryan, Bullock, Burke, Camden, Chatham, Clarke, Columbia, Effingham, Elbert, Emanuel, Franklin, Glascock, Glynn, Greene, Hancock, Hart, Jackson, Jefferson, Johnson, Laurens, Liberty, Lincoln, Madison, McDuffie, McIntosh, Montgomery, Oconee, Oglethorpe, Richmond, Screven, Taliaferro, Tattnall, Warren, Washington, and Wilkes counties.
  * ABounty land grants were made to veterans of the Revolutionary War in lieu of monetary compensation for military service. A second act of 25 February 1784 created new counties and designated some of the area as bounty lands for veterans who had served in the Continental Line or Navy. Most of the area that later became Greene County was reserved for bounty land grants. Other bounties were made to citizens, refugees, or militiamen. See Silas Emmett Lucas, Jr., Index to the Headright and Bounty Grants of Georgia, 1756-1909 (Vidalia, Ga.: Georgia Genealogical Reprints, 1970). The Georgia Department of Archives and History and the FHL have microfilm copies of original land grants.
  * AOnly Georgia has the distinction of distributing lands by lottery. Georgia acquired large parcels of Indian land as a result of an 1802 treaty between the United States and the Creek Nation. The new lands were located in the northern and western sections of present-day Georgia and were parceled out through a series of land lotteries which gave every Georgian an equal chance to obtain land by draw. The first lottery took place in 1805 and was followed by others in 1807, 1820, 1821, 1827, and two in 1832. All Georgia citizens were eligible to qualify for a lottery, although the 1830, 1827, and 1832 lotteries gave special consideration to war veterans. Published lottery books are excellent sources for pinpointing where a Georgia family lived when a lottery was held. Land in the following counties was distributed by lottery: Appling, Baldwin, Carroll, Cherokee, Coweta, Dooly, Early, Fayette, Gwinett, Habersham, Hall, Henry, Houston, Irwin, Lee, Monroe, Muscogee, Rabun, Troup, Walton, Wayne, and Wilkinson.
  * A... After land was granted by the state, the owner could transfer or dispose of the property as desired. Record of subsequently property transfers was made at the county level by the clerk of the superior court. Copies of deeds and mortgages can be obtained from that office in the respective counties. The FHL has microfilm copies of many county land records.
